'Dream' Comes True: California Court Dismisses Claims

A Los Angeles superior court yesterday dismissed breach of contract, unfair competition, and all other claims brought against three members of the hugely successful pop music group “Dream” and their parents.

Members of Kirkpatrick & Lockhart LLP’s entertain- ment practice in Los Angeles managed the group’s defense in the civil suit originally filed in January of this year, wherein the defendants’ original talent agency, Judith Fontaine dba Fontaine & Daughters Productions, alleged damages in connection with the group’s termination of its relationship with her.

K&L partner and lead attorney in the matter, Paul W. Sweeney, Jr. (who was assisted by K&L associate attorney Jill L. Varon) indicated that he was very pleased with the judge’s finding.

In dismissing the claims, Judge Owen Lee Kwong found that the members of Dream had legally exercised their statutory right as minors under California Family Code Section 6710 to disaffirm a settlement agreement with Fontaine prior to the release of Dream’s chart topping first album.

Mr. Sweeney further commented, “We always maintained that the lawsuit had no merit. “Founded only two years ago, Dream has had meteoric success with their single “He Loves You Not,” which was in the top five of the Billboard singles chart, and with its recently released album “It Was All A Dream,” which has already achieved double platinum sales.
